1. Directing at the existing problems in china`s judicial appraisal institution, the writer thought we can make it perfect from the following aspect s.1.realize the separation appraisal organization from judicial organ, build the unified manage system.2.establish unified judicial appraise organization with there ranks 3.draw up unified standards on appraisal basis, procedure, and so on 4.examine its qualifications in advance complemented by judge`s temporary check 5.judeg the power to entrust and decide the appraisal give person concerned the power to apply for appraise and choose referee.6.establish the cooperate appraisal institution 7.perfect the evading system, guarantee neutral and just place of referee 8.perfect the program me of the conclusion`s certification and adopting 9.setup appraisal witness system.10.perfect the policy of referee`s testifying on the court and confirm responsibility in case he breaks his duty.
针对我国司法鉴定制度中存在的问题，笔者认为应从以下几个方面入手来完善我国司法鉴定制度。1、实现专职司法鉴定机构同公、检、法三机关的分离，建立统一的司法鉴定管理体制。2、建立一元化的三级专职司法鉴定机构。3、应规定司法鉴定的鉴定依据、方法步骤、鉴定结论和鉴定语言的统一标准。4、对司法鉴定的主体资格实行以司法鉴定管理机构的预先审定为主、以法官临时审查为辅的制度。5、司法鉴定的委托权、决定权由法官行使，同时赋予当事人司法鉴定申请权和申请回避权及选任鉴定人的权利。6、设立合议鉴定制度。7、完善鉴定人的回避制度，保证鉴定人的中立和公正。8、完善鉴定结论的质证、认证和采信程序。9、设立鉴定证人制度。10、完善鉴定人出庭作证制度以及违背此项义务的法律责任。
